Marvel’s Loki will see the titular God of Mischief captured and tried by the TVA’s Time-Keepers – here’s why The Avengers were never arrested for similar offenses. Played by Tom Hiddleston, Loki has been a popular part of the MCU. As such, the character was rapidly given a new lease of life following his death in Avengers: Infinity War. On a newly created timeline branch, a variant of Loki was last seen escaping with the Tesseract. As per released footage for Loki, he will almost immediately be caught by the Time Variance Authority. Set to face trial and potentially be erased from existence, the pre-redeemed trickster will instead be recruited by Owen Wilson’s Mobius M. Mobius to help fix the chaos he created.

The unveiled story details only led to several questions, especially in relation to Tony Stark (Robert Downey Jr.), Steve Rogers (Chris Evans), and the rest of the superhero team. In order to reverse the damage of Thanos’ infamous snap, the group embarked on a “time heist”. Revisiting the sites of past adventures, The Avengers similarly created timeline branches — both by their mere presence and when also plucking infinity stones from their established places in history. Technically, it was because of their interference that variant version(s) of Loki were even created and able to wreak havoc. As such, many queried why the agents of the TVA didn’t swoop in at any point to similarly arrest Iron Man, Captain America, et al.

The answer has actually already been revealed by Hiddleston himself. As well as an increasing amount of trailers and TV spots, the actor has also been on the promotional trail as Loki’s first episode looms. In one such recent interview, Hiddleston explained the TVA organization and the nature of time prisoners, stating: “The TVA have predetermined what happens in the past, the present, and the future – in a straight line.” In other words, like Doctor Strange (Benedict Cumberbatch), they would have foreseen the events of Avengers: Endgame and determined the timeline meddling as necessary to whatever future the TVA have steered “the sacred timeline” towards. Likely because The Blip reconstituted integral people, the “time heist” was probably designated what folks on Doctor Who would call a fixed point. Therefore, the aforementioned Time-Keepers presumably afforded The Avengers some leeway.

That foreknowledge also meant that the Time Variance Authority knew that the original Captain America would “clip the branches” they’d created. Unlike Loki, who was content to run rampant and no doubt create branches on top of branches, The Avengers at least intended to put things back right. The TVA would’ve appreciated that fact – with the tangents sealed immediately (from a time standpoint) after they were created and the structural integrity of “the sacred timeline” only temporarily at risk. Cap essentially did their job for them, with the exception of the Loki variant, which they could more expertly handle themselves.

That could also be why the TVA didn’t even view Captain America’s retirement timeline with Peggy (Hayley Atwell) as an arrestable offense. Given everything, they probably agreed that he deserved his chosen reward. Plus, with their foreknowledge, they already knew he’d ultimately return to the prime timeline and, again, further their preordained future. As such, though he’d been able to live an entire life there, his returning mere moments after he left also meant they could similarly clip that branch soon after it had been created. Of course, the new information only sparked new and further questions. Principal among them would be what future, exactly, has the TVA worked towards? That (and references to how the Time-Keepers view The Avengers’ actions) will no doubt be a firm part of the Loki series when it’s released.
