RHOSLC Federal Judge Denies Jen Shah’s Appeal To Dismiss Case

A federal judge has denied the motion to dismiss The Real Housewives of Salt Lake City star Jen Shah’s fraud case in relation to the release of a recent Hulu documentary. Jen argued that because the documentary discussed her ongoing legal battle, it would interfere with her ability to receive a fair trial. Jen and her assistant were arrested in March and charged with fraud and money laundering related to their involvement in a telemarketing scheme that has been noted to have preyed upon the elderly.

Jen first appeared on The Real Housewives of Salt Lake City season 1 in 2020 and quickly became one of the show’s most controversial cast members as the feuds between her and the rest of the cast exploded throughout the season, but things took a shocking turn when Jen’s drama went from classic drink throwing to a televised arrest in season 2. Jen and her assistant Stuart Smith were arrested for crimes relating to a telemarketing scheme. The two pleaded not guilty initially, but recently Stuart changed his plea to guilty. Both Jen and Stuart potentially face multiple decades in prison. A documentary produced by ABC News Studios in collaboration with Hulu titled The Housewife & the Shah Shocker, which chronicled Jen’s current legal troubles, became the second installment of its kind on November 29. Previously, Hulu released The Housewife & The Hustler; a documentary following the legal battles of The Real Housewives of Beverly Hills star Erika Jayne. Jen criticized the documentary on social media, and asked that her case be dismissed as a result of its release.

On Friday, a federal judge denied Jen’s request to have the case dismissed. While Jen’s attorneys have claimed that the documentary is an obstacle in regards to being able to receive a fair trial, Judge Sidney H. Stein disagrees. In a U.S. District Court filing for the Southern District of New York obtained by People, Judge Sidney stated that “there has been no evidence whatsoever proffered to suggest that Shah’s right to a fair trial has been compromised or prejudiced in any respect.”

The judge continued, explaining that appropriate legal measures would be taken to ensure that the jury selected for the case would be unpartial, similar to any other case. Upon word of the judge’s latest ruling, Jen’s attorneys were reached for comment but did not respond at the time of the request. While Jen’s assistant Stuart recently pleaded guilty, Jen still maintains her innocence at this time.

Considering what fans have seen of Jen throughout her time on The Real Housewives of Salt Lake City, outlook for her legal situation does not look particularly good. Outside of the legal situation itself, fans have been able to note Jen’s behavior as often being dishonest and manipulative, and the Hulu documentary is equally as unhelpful to her case. It is probably not out of bounds to say the documentary could cause difficulty in maintaining a fair trial; however, it can be argued that the documentary is not anymore of an interference to the trial than the behavior she engaged in on The Real Housewives of Salt Lake City. It is worth noting that, unlike the Hulu documentary, she appeared on season 1 and season 2 of the reality series willingly. Additionally, she allowed her arrest to become part of her story arc when choosing her season 2 tagline.
